When can you challenge a Will in Sydney?

If there are doubts about the testator’s mental capacity at the time they constructed the Will (lack of a testamentary mental capacity).

If you believe someone pressured the testator into altering the Will to leave assets to certain people (undue influence).

If you believe the Will was forged, either wholly or partly, by an unknown party or one or more of the beneficiaries (forgery).

If you believe the testator was tricked into constructing the Will in a certain way (fraud).

If there are doubts about whether the Will was signed and witness properly.

If you believe the Will has not provided adequately for eligible dependents.

If the Will is out-dated and there is a new Will.
